Man convicted in toddler death gets new trial

KALAMAZOO, MICH. - Michigan appeals court judges are giving a Kalamazoo man a new trial, for the alleged child abuse murder of his two-year-old son.

Brian Roberts, 43, is serving life in prison without parole, for the 2014 death of his son, Nehemiah Dodd.

Prosecutors alleged he abused the toddler, causing catastrophic head trauma.

In a ruling released today, appellate judges say Roberts' attorney, failed to get expert testimony, supporting a theory that the boy's death was an accident.

Roberts' attorney in his first trial, a former prosecutor, now represents Jason Dalton, who is charged with killing six people in a shooting rampage in the Kalamazoo area.
