Charges filed for driver in fatal wrong-way crash

GRAND RAPIDS (WZZM) - Two days after a wrong-way accident killed a Greenville elementary school teacher the other driver is being charged with causing the crash.

Police say Monday morning's accident was caused by a drunk driver going south in the northbound lanes of East Beltline near 5 mile road.

 

A judge formally charged that driver in his hospital room.

 

According to Michigan State Police - Leonel Franco-Avina's blood alcohol level was point four two that's 5 times the legal limit.

 

The 38-year -old was arraigned at Spectrum Health Hospital on 2nd degree murder charges at 3:30 this afternoon. Avina was driving the wrong way in the northbound lanes of the East Beltline in Plainfield Township.

 

Avina struck and killed 30 year old first grade teacher Aaron Haynes who was driving to work at Lincoln Heights Elementary School.

 

Investigators say Avina had a Washington state id as well as identification from Mexico. According to MSP Avina lived in Washington and moved to Wyoming to live with his sister.

 

Avina is in stable condition he has two broken hips with bumps and bruises.
