EAST LANSING, Mich. (AP) -- An attorney for state Rep. Bob Genetski has waived the lawmaker's arraignment on a drunken driving charge.

Ingham County Chief Assistant Prosecutor Lisa McCormick says a court date hasn't been set for Genetski, a Republican from Saugatuck in southwestern Michigan.

He was ticketed Jan. 19 in East Lansing.

McCormick says Genetski refused to take a Breathalyzer at the scene and was arrested. A blood alcohol test later was taken. Michigan's legal limit is 0.08 percent.

He also was given a warning about excessive speed and driving on an expired license plate.

Genetski has said he refused the Breathalyzer because he believes he passed a field sobriety test. He calls the experience "humbling."

Defense attorney Mike Nichols says Genetski "still believes he was safe and sober."
