HOLLAND, Mich. (WZZM) -- Prosecutors say he was in the U.S. illegally during a deadly crash in Holland, and on Wednesday, the 30-year-old driver was charged with drunk driving and causing the death of a motorcyclist on Sunday.

His two passengers are also being detained, without charges against them.

Evidence at the crash scene tells part of the story. Understanding the rest of it has presented additional challenges.

In court Wednessday, an interpreter translated the felony charges against Eulises Mora-Hernandez, who prosecutors say is in the U.S. illegally.

Investigators say he was driving an SUV with two passengers when he collided with a motorcycle on 32nd Street Sunday.

Holland Police Captain Rick Walters says the SUV driven by Mora-Hernandez crossed the center line and hit 57-year-old David Achterhof, who was taken to the hospital, where he died.

Police say Mora-Hernadez, who had alcohol in his system, left the scene and was later arrested.

He's charged now with OWI causing death, driving with license suspended causing death, and leaving the scene of a fatal accident.

Investigators say Mora-Hernandez and his passengers were migrant workers, originally from Mexico, living in Grand Rapids.

His two passengers are being detained without charges, which state law allows if they are believed to be a flight risk.

"They are material witnesses to this case and we don't want to lose their testimony," said Captain Walters.

If convicted, Mora-Hernandez could spend at least 15 years in state prison.

"Upon serving his sentence, he would then be discharged into the custody of ICE," Captain Walters explained.

Then, ICE would decide his fate.

Mora-Hernandez was previously in Florida and had been living in the U.S. for eight to nine years, his attorney told the court.

He's now held on $250,000 bond.

His probable cause hearing is expected in the next two weeks.
