The Ohio State Board of Trustees announced Friday afternoon that it will not consider former band director Jonathan Waters request to be reinstated at their next board meeting.

In a letter dated Aug. 15, 2014 obtained by USA TODAY Sports, Jeffrey Wadsworth writes on behalf of the Board of Trustees that they will not "take any action regarding Mr. Waters and will not review the matter at our upcoming meeting."

The letter states that the board "stands firmly behind the Office of University Compliance's investigation and the University's decision to terminate Mr. Waters."

THE LETTER: Board won't consider request

Waters was fired last month after a two-month university investigation uncovered "a sexualized culture" within the band. Waters formally requested that he be reinstated Thursday.

"We're not surprised, but we are very disappointed," Waters' attorney David Axelrod told USA TODAY Sports upon hearing the Board of Trustees decision. He had yet to read the letter himself. "You would think that common decency would cause the university to give someone of Jonathan's stature, who has done so much for this university, an opportunity to be heard.

"It's sad that the university is basing these actions on a report that is so deeply flawed that no one believes it but the university. And it's hard to imagine that the university really believes it anymore either. This behavior is not worthy of a great university."

Axelrod has not discussed the next step with Waters yet.

"He doesn't want to sue Ohio State, but litigation remains an option," Axelrod said.‚Äč
