No one to be charged for Ionia County inmate death

An inmate will not face charges after a prison fight that led to the death of another inmate from Muskegon. The Department of Corrections confirmed in September that  24-year-old Dustin Szot died at the Bellamy Creek Correctional facility.

An inmate will not face charges after a prison fight that led to the death of another inmate from Muskegon. The Department of Corrections confirmed in September that 24-year-old Dustin Szot died at the Bellamy Creek Correctional facility.

Kyle Butler, the Ionia County Prosecutor released a statement Friday, March 31, saying that the prisoner "acted in lawful self-defense when he was attacked."

A Department of Correction spokesman says Szot refused to stop fighting with another inmate and was tased by corrections officers. He could not be revived after the September incident.

The Prosecutor decided not to file charges after witness testimony and video surveillance. In the statement, the prosecutor said, "It can be characterized as a freak and unusual result of these rather unremarkable punches by the prisoner."

WZZM 13 news spoke to Szot's family back in September and at the time they said they blamed excessive force from the correctional facility for his death. Saying a prisoner contacted them who says he witnessed what happened.
