Body camera video shows man charge at Battle Creek police officer before another officer fatally shoots him

During the struggle with the officer, the man was able to disarm her and use her service weapon to shoot her in the leg.

Battle Creek Police have shared additional information and body camera footage showing the struggle that left a police officer injured and a man dead.

On Thursday, employees at Café Rica in downtown Battle Creek asked officers to respond after a man inside the restaurant was concerning management with his behavior. 

The man, identified as 29-year-old Dario Agudelo, of Texas, left the restaurant. Around 3 p.m., police say Agudelo committed a felonious assault on Monroe Street in Battle Creek. He then returned to Café Rica around 3:30 p.m. and restaurant management again requested police to respond.

Agudelo was originally compliant, but police say he refused to cooperate when an officer attempted to detain him. He then began walking toward the officer and disregarding her commands, police say. 

The officer deployed her Taser, which had no effect, and Agudelo tackled the officer and began to fight her. During the struggle, he managed to take her service weapon and shoot her in the leg.

A backup officer also attempted to tase Agudelo, but it again had no effect. The officer then shot him.

While life-saving efforts were attempted, Agudelo was pronounced dead at the scene.

The injured officer was taken to a hospital for treatment. On Friday, Battle Creek Police Chief Shannon Bagley said she was "doing well."

Friday afternoon, police confirmed that the officer had been released from the hospital. 

During a press conference Friday, police showed body camera footage from both officers. It shows how quickly the incident happened.

“That video kind of speaks volumes,” Bagley said. “Their decisions are nanoseconds sometimes, especially when you have to consider an officer’s size compared to the individual's size that they’re dealing with."

He said Agudelo was 6'2" and about 300 pounds.

Bagley said that although the loss of life is tragic, he's proud of how quickly his officers responded.

"This is a horrific situation, we wish that it had not occurred," Bagley said. "All things considered, we’re sorry that there was a loss of life, but we are also very blessed that the officer is also going to be fine. Yeah, it’s a tough day.”

Both officers involved in the incident have been placed on administrative leave. The Michigan State Police is now investigating.
