Former Grand Rapids Police officer says Michigan appeals court made mistake in ruling to send him to trial

Last month, an appeals court ruled there is enough evidence to send ex-GRPD Officer Christopher Schurr to stand trial for the murder of Patrick Lyoya.

KENT COUNTY, Mich. — Attorneys for the former Grand Rapids Police Officer charged with murder in a 2022 traffic stop killing are asking the appeals court to reconsider their findings. 

Christopher Schurr is charged with second-degree murder after shooting Patrick Lyoya in the back of the head following a traffic stop in April of 2022.

His counsel filed an appeal arguing that Schurr was justified in using deadly force, citing he was protected under the "fleeing-felon rule." 

However, last month, the Michigan Court of Appeals ruled there is enough evidence for former GRPD Officer Christopher Schurr to stand trial for the murder of Patrick Lyoya.

On Feb. 15, attorneys representing Schurr filed a motion for the appeals court to reconsider their findings.

"Officer Schurr respectfully argues that this Court’s opinion affirming bindover was based on palpable factual and legal errors that, if corrected, would result in a different disposition," the motion says.

Kent County Prosecutor Christopher Becker expects Schurr to also appeal to the Michigan Supreme Court.
