DENIED | Michigan appeals court will not honor request to reconsider sending ex-GRPD officer to trial for murder

Christopher Schurr is charged with second-degree murder after shooting Patrick Lyoya in the back of the head following a traffic stop in April of 2022.

KENT COUNTY, Mich. — The Michigan Court of Appeals won't reconsider its ruling that there is enough evidence to send former Grand Rapids Police Officer Christopher Schurr to trial for murder in a 2022 traffic stop killing.

In a 2 to 1 vote, the judges denied Schurr's attorney's motions first filed on Feb. 15.

Schurr is charged with second-degree murder after shooting Patrick Lyoya in the back of the head following a traffic stop in April of 2022.

His counsel filed an appeal arguing that Schurr was justified in using deadly force, citing he was protected under the "fleeing-felon rule." 

However, last month, the Michigan Court of Appeals ruled there is enough evidence for Schurr to stand trial for the murder of Lyoya.

After filing the appeal for reconsideration, Schurr's attorneys stated that the court's decision was based on legal errors. 

"Officer Schurr respectfully argues that this Court’s opinion affirming bindover was based on palpable factual and legal errors that, if corrected, would result in a different disposition," the motion says. 

Kent County Prosecutor Christopher Becker expects Schurr to also appeal to the Michigan Supreme Court.
